These Terms & Conditions ("Terms & Conditions" or "Agreement") constitute a legally binding agreement between INEZ Estate Management ("INEZ," "we," "us," or "our") and any individual or entity ("you," "user," "tenant," or "customer") who accesses, applies for, rents, or uses our services.

By accessing or using our services, you agree to be bound by these Terms & Conditions.

Scope of Services

INEZ Estate Management provides property-related services including, but not limited to:

  • Tenant account management platforms
  • Payment processing and receipt verification
  • Administrative and operational support services

All services are subject to availability, approval, and compliance with these Terms & Conditions and any applicable rental agreement.

Eligibility & Authority

You confirm that:

  • You are at least 18 years of age
  • You have the legal authority to enter into this Agreement
  • If acting on behalf of a business, you are authorized to bind that business

Providing false or misleading eligibility information may result in immediate termination.

Rental Applications & Approval

Submission of a rental application:

  • Does not guarantee approval
  • Is subject to verification, review, and internal approval
  • May require submission of supporting documentation

INEZ reserves the right to:

  • Accept or reject applications at its sole discretion
  • Request additional documentation
  • Suspend processing where information is incomplete or unclear

Rental Terms & Occupancy

Approved tenants agree to:

  • Use rented spaces only for approved business purposes
  • Comply with building rules, safety requirements, and occupancy limits
  • Avoid activities that cause damage, nuisance, or legal risk

Subletting, assignment, or unauthorized sharing of space is strictly prohibited unless approved in writing.

Payments, Billing & Financial Obligations

Currency & Payment Methods

  • All charges are denominated in BBD (Barbadian Dollars)
  • Payments are processed via national banking systems or approved payment gateways

Subscription & Recurring Charges

  • Rental services may operate on a subscription or recurring billing basis
  • Subscriptions automatically renew unless cancelled in accordance with agreed notice periods

Late Payments

Failure to pay on time may result in:

  • Service suspension
  • Access restriction
  • Termination of rental agreements
  • Legal recovery action where applicable

Refund Policy

  • Full refunds apply only as outlined in the applicable rental agreement
  • Refund eligibility may depend on notice periods, contract terms, or service usage
  • Processing timelines may vary depending on banking institutions

Security Deposits

Where required:

  • Deposits may be held to cover damage, unpaid charges, or breaches
  • Deductions may be made where justified
  • Remaining balances will be refunded in accordance with agreement terms

Intellectual Property Rights

All intellectual property, including:

  • Logos
  • Branding
  • Platform design
  • Text, graphics, and software

is owned exclusively by INEZ Estate Management.

No rights or licenses are granted except as strictly necessary to use the services.

Prohibited Activities

Users and tenants must not:

  • Engage in unlawful or fraudulent activities
  • Damage or interfere with property or systems
  • Attempt unauthorized access to systems or data
  • Copy, scrape, or misuse platform content
  • Use services in a way that exposes INEZ to legal or reputational risk

Violations may result in immediate termination.

Suspension & Termination

INEZ reserves the right to:

  • Suspend access at any time
  • Terminate services immediately for violations
  • Terminate agreements for non-payment, misrepresentation, or risk exposure

Termination does not waive outstanding obligations.

Limitation of Liability

To the maximum extent permitted by law:

  • INEZ is not liable for indirect, incidental, or consequential damages
  • INEZ is not responsible for business losses, data loss, or downtime
  • Liability is limited to fees paid for services, where applicable

Services are provided "as is" and "as available."

Indemnification

You agree to indemnify and hold harmless INEZ from:

  • Claims arising from your misuse of services
  • Breaches of this Agreement
  • Violations of law or third-party rights
  • Actions of your employees, contractors, or visitors

Force Majeure

INEZ is not liable for failure or delay caused by events beyond reasonable control, including:

  • Natural disasters
  • Power outages
  • Government actions
  • Banking system disruptions
  • Internet or infrastructure failures

Privacy & Data Protection

Use of services is also governed by our Privacy Policy, which explains how personal data is collected, used, and protected.

The Privacy Policy is incorporated into these Terms & Conditions by reference.

Modifications to Services or Terms

INEZ may:

  • Modify services, pricing, or features
  • Update these Terms & Conditions at any time

Changes become effective upon publication. Continued use constitutes acceptance.

Governing Law & Jurisdiction

This Agreement is governed by the laws of Barbados.

All disputes shall be subject to the exclusive jurisdiction of the courts of Barbados.

Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement

These Terms & Conditions, together with:

  • Rental agreements
  • Privacy Policy
  • Any written addenda

constitute the entire agreement between you and INEZ Estate Management.
